Except as provided in this chapter, all solid waste accumulated in the city, except for hazardous wastes, shall be collected, conveyed and disposed of by the City of Gas or its designated hauler. The city reserves the right to not provide trash service to certain citizens, but any solid waste collection provider used by these citizens must be approved by the city. No persons shall collect, convey over any of the streets or alleys of the city, or dispose of any solid waste accumulated in the City of Gas, except as follows:

(a)   Exception for outside commercial collectors. This article shall not prohibit outside commercial collectors of solid waste from hauling such solid waste over city streets, provided that:

(1)   Such outside commercial collectors comply with the provisions of this chapter and with any other governing law or ordinances;

(2)   Said outside commercial collectors may only contract with commercial accounts that are not serviced and cannot be serviced by the city or its designated contract hauler after the effective date of this chapter; and

(3)   Said outside commercial collectors or the commercial account holder provides the city with satisfactory evidence that said account is being hauled by an outside commercial collector.

(b)   Exception for outside commercial collectors and private residences. Commercial collectors can contract with residential customers on a temporary basis for the purpose of setting out dumpsters as long as said residential customer maintains uninterrupted solid waste collection services with the City of Gas. A dumpster remaining at a residence for more than a 30-day period shall not be considered on a “temporary basis” for purposes of this section and shall be in violation of this section.

(c)   Required service. All citizens of the City of Gas who establish water service after August 1, 2010, are required to use solid waste collection services offered by the City of Gas or its designee. The city reserves the right to not provide trash service to certain citizens, but any solid waste collection provider used by these citizens must be approved by the city. All fees and charges for solid waste collection shall be assessed to the utility bill of every water customer within the city limits for every active water meter established after August 1, 2010. Said fee may, at the option and upon a vote by the city council, be waived if proof to the satisfaction of the city council is provided by the person whose name the water meter is registered to that a water meter is not serving a residence.

There shall be charged, assessed and collected from each residence, business or industry that uses the solid waste service provided by the City, a fee of $10.00 per month added to the monthly utility bill.
