APPENDIX C – ZONING REGULATIONSAPPENDIX C – ZONING REGULATIONS\ARTICLE VIII. NON-RETAIL COMMERCIAL DISTRICT (CO)

8-1.01 The regulations set forth in this section, or set forth elsewhere in these regulations, when referred to in this section, are the regulations in the Non-Retail Commercial District (CO). The purpose of this district is to provide for office and non-retail business developments that provide a service or support a neighborhood or community. This district is also intended to be used as a transition, where deemed appropriate, from residential developments to more intensive types of commercial and/or retail business activity.

8-2.01 In a Non-Retail Commercial District no building, land, or premises shall be used and no building or structure shall be hereafter erected or altered unless otherwise provided for in these regulations, except for the following uses:

1.     Office and office buildings to be used only for the administrative functions of companies, corporations, social or philanthropic organizations or societies.

2.     Medical and dental clinics.

3.     Other offices limited to the following:

a.     Accountants.

b.    Architects, landscape architects, planners, and other similar professions.

c.     Artist studios.

d.    Brokers.

e.     Engineers, surveyors.

f.     Dentists, dental laboratories.

g.    Lawyers.

h.    Physicians, osteopaths, chiropractors.

i.     Real estate.

j.     Insurance.

4.     Radio and television studios, provided no broadcasting towers are located on the premises.

5.     Day-care centers and preschools, provided all state and county licensing requirements are met.

6.     A pharmacy wherein retail sale only of prescription medicines, drugs, pharmaceuticals and orthopedic devices, customarily incident to the practice of medicine, shall be allowed as an accessory u se in an office building provided not less than five physicians occupy offices within the building. No direct exterior entrance and no exterior sign or advertising relative to the pharmacy shall be permitted.

7.     Accessory buildings and uses customarily incidental to the above uses, provided there shall be no manufacture, processing or compounding of products other than such are customarily incidental and essential to such permitted use. Accessory buildings and uses shall be constructed in a style and manner similar and sympathetic to a principal building or use.

8.     If such land placed in this district is adjacent to a zoning district with an R (R, RL, RM, RMH, RE AND RH) in the title in which a single household home is permitted, no article or material stored or offered for sale in connection with uses permitted above shall be stored or displayed outside the confines of a building unless it is so screened by permanent ornamental walls, fences or planting that it cannot be seen from adjoining streets or lots when viewed by a person standing on ground level.

9.     No screening in excess of six feet in height shall be required.

8-3.01 No merchandise shall be handled or displayed except inside buildings and no equipment or vehicles other than motor passenger cars shall be stored outside a building in this district.

8-4.01 One off-street parking space shall be provided for each 250 square feet of floor area.

8-5.01 Height. Buildings or structures shall not exceed 21h stories in height and/or 30 feet.

8-5.02 Front yard. The depth of the front yard shall be at least 25 feet.

8-5.03 Side yard. There shall be a side yard on each side of a building; no side yard shall be less than 15 feet.

8-5.04 Rear yard. The depth of the rear yard shall be at least 25 feet.
